General Conditions of Sale
Preamble :
The order of products presented in the Couleur Course electronic catalog is subject to the acceptance by the customer of all the General Conditions of Sale set out below.
These General Conditions of Sale apply to the customer to the exclusion of all other conditions, in particular those in force for in-store sales, and without regard to any special clauses added by the customer – unless expressly agreed by the seller – or to advertising documents issued by Couleur Course or any other document.
Acceptance:
The customer's acceptance of these conditions is materialized by his electronic signature, materialized by the "validation click", as well as by the communication of his bank details for the purposes of payment of his order. This electronic signature has the value of a handwritten signature between the parties. This double step is equivalent for the customer to acknowledge that he has fully read and approves without reservation all of these conditions.
Products:
The presentation visuals illustrating the products offered in the electronic catalog of Couleur Course tend to describe and present the articles with the greatest accuracy. However, the settings of computer screens, smartphones of different brands can cause a variation in colors. Therefore these visuals cannot be considered as entering into the contractual field and the minimal variations in the representation of the articles can neither engage the responsibility of Couleur Course nor affect the validity of the sale.
Availability :
Our product offers and prices are valid as long as they are on the site, within the limits of available stocks. Information on the availability of products is provided to the customer at the time of ordering. In the event of unavailability after placing the order, we will inform the customer by email and we undertake either to provide replacement items with similar or superior characteristics and qualities at an equal or higher price, or to reimburse the customer if their bank account has been debited.
Order :
Automatic recording systems are considered as proof of the nature, content and date of the order. Couleur Course confirms acceptance of the order to the customer at the email address provided by the customer. The sale will only be concluded once the order has been confirmed, Couleur Course reserves the right to cancel any order from a customer with whom there is a dispute regarding the payment of a previous order. The products can only be delivered to the delivery address indicated by the customer during the ordering process. The information provided by the customer when placing the order is binding on the customer: in the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.
The buyer, who wishes to purchase a product or service, must:
– complete the identification form on which he will indicate all the requested contact details or give his customer number if he has one;
– complete the online order form, providing all the references of the products or services chosen;
– validate your order after having checked it;
– make the payment under the conditions provided;
– confirm your order and payment.
Confirmation of the order entails acceptance of these conditions of sale, recognition of having full knowledge of them and the waiver of relying on one's own conditions of purchase or other conditions.
All data provided and the recorded confirmation will be proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out. The seller will communicate by email confirmation of the recorded order.
Delivery :
After confirmation of the order, Couleur Course undertakes to deliver to its carrier all the references ordered by the buyer.
The customer must notify the carrier and Couleur Course of any reservations regarding the delivered product (damaged package, already opened, etc.) within three days of receipt of the product.
In the event of apparent defects, the customer has the right to return the item under the conditions set out in this document.
In addition, for deliveries outside mainland France, the customer agrees to pay all taxes due on the importation of products, customs duty, value added tax, and all other taxes due under the laws of the country where the order is received.
Force majeure:
The following are considered cases of force majeure releasing the seller from his obligation to deliver: war, riot, fire, strikes, accidents and the impossibility of being supplied. Goods always travel at the recipient's risk. The customer is required to check his package upon arrival. He has 48 hours to make any reservations with the carrier in the event of missing or damaged items.
Withdrawal:
In accordance with article L 121-16 of the Consumer Code, the customer has a period of 7 clear days from delivery to return to Couleur Course any items that do not suit them, with the exception of sale items or personalized items, for exchange or refund, without penalty except for shipping costs.
Returns must be for new items in their original packaging, accompanied by all their possible accessories, instructions for use and documentation. Returns must be sent to the address indicated on our contact page.
Items returned incomplete, damaged, spoiled or soiled will not be accepted.
In the event of abnormal or abusive returns, Couleur Course reserves the right to refuse a subsequent order.
In the event of exercising the right of withdrawal, Couleur Course is required to reimburse the sums paid by the customer, free of charge, with the exception of return costs. The refund is due within a maximum of 15 days.
Price :
The price is expressed in euros (€).
The price charged to the customer is the price indicated on the order confirmation sent by Couleur Course . This price is expressed inclusive of all taxes and including VAT for France and EU countries. It includes the price of the products, handling, packaging and storage costs of the products, transport and commissioning costs.
Couleur Course reserves the right to modify prices at any time. However, for any accepted order, Couleur Course guarantees the prices in effect on the date the order is confirmed .
Payment :
The order validated by the customer will only be considered effective when the relevant bank payment centers have given their agreement. In the event of refusal by said centers, the order will be automatically canceled and the customer notified by email. Furthermore, Couleur Course reserves the right to refuse any order from a customer with whom there is a dispute.
Payments will be made by credit card; they will be made through the secure Paypal system.
At the buyer's request, a paper invoice showing the VAT will be sent to him.

Intellectual property:
The site is the property of Couleur Course in its entirety, as well as all related rights.
Any reproduction, in whole or in part, of the site is systematically subject to authorization from Couleur Course .
Responsibility :
The products offered comply with current French legislation and the standards applicable in France. Couleur Course cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is the customer's responsibility to check with the local authorities the possibilities of importing or using the products.
Couleur Course cannot be held liable for any damage whatsoever resulting from a professional activity (loss of business, loss of profit, loss of opportunity, damages and costs).
In any event, the customer benefits from the legal guarantee of eviction and hidden defects (art. 1625 et seq. of the Civil Code); on condition that the buyer proves the hidden defect. The seller must legally repair all the consequences (art. 1641 et seq. of the Civil Code). If the buyer goes to court, he must do so within a "short period" from the discovery of the hidden defect (art. 1648 of the Civil Code).
Personal information:
The provision of personal information collected for the purposes of distance selling is mandatory, as this information is essential for processing and delivering orders, drawing up invoices and warranty contracts. Failure to provide this information will result in the order not being validated.
The customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification and deletion of data concerning him, which he can exercise with Couleur Course .
Couleur Course undertakes not to disclose to third parties, free of charge or with compensation, the information communicated by the customer. This information is confidential. It will only be used to process the customer's order and to strengthen and personalize the communication of products reserved for Couleur Course customers, in particular through Couleur Course newsletters to which the customer has subscribed as well as in the context of personalizing the site according to your interests.

Dispute Resolution:
This contract is subject to French law. Couleur Course cannot be held responsible for damages of any kind, whether material, immaterial or physical, which could result from a malfunction or improper use of the products sold. The same applies to any modifications to the products resulting from the manufacturers. The liability of Couleur Course will, in any event, be limited to the amount of the order and cannot be called into question for simple errors or omissions which could have remained despite all the precautions taken in the presentation of the products. In the event of difficulties in the application of this contract, the customer has the possibility, before any legal action, to seek an amicable solution in particular with the help of a professional association in the sector, a consumer association or any other advisor of his choice. It is recalled that the search for an amicable solution does not interrupt the "short period" of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the assessment of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors his financial commitments to the seller.
